Payments & Returns

IAE makes all efforts to make the platform as transparent as possible to safeguard the interests of the art buyer as well as the artist. IAE understands that buying or selling original art over the internet may be a tricky deal and hence the levels of transparency incorporated by IAE shall be assuring for the art buyer as well as the artist.

The IAE Purchase Process

While the art buyer can proceed with an instant check-out for items valued below Rs. 5000 on the IAE website, artworks valued over Rs. 5000 can be purchased after previewing its current video. The art buyer can pay 5% of the art value or Rs. 500/- (whichever is higher) as ‘token amount’ to show ‘intent of purchase’ and request for a current video footage of the artwork. The artist shall arrange to showcase a current video of the artwork. Once the art buyer is satisfied with the current state of the artwork, the balance 95% payment shall be done by the art buyer and the sale can be executed with the delivery process of the artwork. While IAE typically updates the website as soon as a piece is sold, there may be an occasional lag in the process. In case, if the artwork an art buyer has paid for or shown intent to purchase for is sold, the amount paid shall be promptly refunded within 24-48 hours of the transaction.

Secure Payment Options

All payments made on IAE are completely secure. You can pay using a credit/debit card, via a pay wallet or via internet banking. We have partnerships with reputed payment gateway firms to ensure complete security for your transactions.

Safeguarding the Art Buyer

The art buyer can pay 5% of the art value or Rs. 500/- (whichever is higher) as ‘token amount’ to show ‘intent of purchase’ and request for a current video footage of the artwork. The artist shall arrange to showcase a current video of the artwork. Once the art buyer is satisfied with the current state of the artwork, the balance 95% payment shall be done by the art buyer and the sale can be executed with the delivery process of the artwork. The artwork shall be packaged with diligent care to ensure that it does not get damaged in transit. It should be noted that there may be differences in the appearance of the artwork on video due to lighting conditions and the surroundings under which the video would have been shot. However, if the art buyer is not satisfied with the current state of the artwork, he/she can ask for a full refund of the token amount and the deal stands cancelled. Such refunds shall be made by NEFT to the bank account details provided by the art buyer within 7 working days from receiving the bank details.

Safeguarding the Artist

In the rare case where an artwork gets delivered in a damaged condition while in transit, the art buyer to be eligible for a refund or return shall have to document the sealed parcel and the unpacking of the sealed parcel until the final artwork is clearly visible in a continuous unedited video as proof of damage to the artwork. There is obviously no dispute if the artwork is received in perfect shape and condition as seen in the video shared by the artist as would be usually expected to be delivered. In rare cases, if any damage is noted and documented, the same shall be shared with the artist and an amicable resolution of the case shall be sought. Any arbitration in this regard shall be settled between the art buyer and the artist.

Our Return Policy

We ensure our clients are fully sure of their choices before making a final purchase, by speaking to them and providing detailed information with visual proof about the artwork. Since the artworks comprise of unique artworks, and shipping is complex because the items are fragile or heavy, we do not entertain returns. However, in the highly unlikely event that an item is delivered to you in damaged condition, we will make things right by finding an acceptable solution. This may include repair, exchange, or in some cases, return of the product.

Return Process

If an art buyer is eligible for return of an artwork as per the terms mentioned above, he/she can raise a return request by writing an email to canvas@indianartexchange.com mentioning the reasons and the link to the documented video as described above. IAE shall provide packing instructions and it would be the art buyers responsibility to courier the artwork at the designated address at the his/her own cost.

Lost / Damaged Shipments

In rare case of lost shipments, we will offer full refunds irrespective of the delivery location or framing state.

Every artwork sold by IAE shall be accompanied by a physical Certificate of Authenticity signed by the artist. IAE enlists and sells only original art and we have no hosting space for prints and dummies.

Packaging and Shipping

Every piece showcased on IAE is exclusive, and some items may be fragile or heavy. The artworks are packaged with diligent care to ensure that it does not get damaged in transit. The artworks listed on IAE can be shipped to any location within India. IAE does not apply any additional shipping cost as all values mentioned on the IAE website are inclusive delivery.

Once your purchase transaction is complete, our team will be in touch with you regarding shipment details. The normal timeframe for delivery of artwork can vary between 3 days to 2 weeks depending on the size and form of artwork. In case the art buyer has any queries regarding the delivery timeframe for their chosen artwork, IAE can be contacted via email or the IAE website chat and we shall confirm the approximate delivery date if not the exact date as the date of delivery can move a few days before or after its schedule due to many factors in the delivery chain. Confirmed orders are typically dispatched within 2 to 5 days depending on the form of artwork ordered.

Buyer Policy

Capitalized terms used but not defined herein shall have the meaning given to them as contained in the User Agreement.

As a Buyer, you understand and accept that upon initiating a Transaction on the website www.indianartexchange.com, you are entering into a legally binding and enforceable contract to purchase the items.

​

As Buyer of Paintings that are listed by other Users (Artists) on the Website, you will be purchasing the work from the Artist directly and ZapPPT Presentations shall be a mediator in facilitating the transaction. The Company will collect your billing and shipping information and process your payment and co-ordinate with the Artist to ship it to the Delivery address provided by you.

The Company reserves the right to cancel any order for a Painting via the Website, if in its reasonable discretion, the item is mispriced, out of stock, or otherwise unavailable at the price listed. In such case, the Company will send you an email confirmation of such cancellation and you will not be charged for your order or refunded in reasonable timeframe if you have already paid for it.

Buyer shall reserve the right to cancel the respective order within 3 (three) hours from period of order placement.

You agree on the commercial terms of the Transaction including terms of Dispatch and Delivery time as published on the website or communicated by way of exchange of electronic records/electronic communication by using the features as may be provided on the Website.

Payment Method: You agree to pay the Transaction Price through the available methods of payment, on the Website. The Website shall notify the Buyer upon Payment Confirmation as provided herein.

​

• Contacting Users: Buyers shall not communicate with other Users about Seller, artworks, pricing, or any other matter, except by using any such facility provided within the Website, if any.


• Contact Information: Save as otherwise provided in the Privacy Policy/Statement, the contact details provided by you on the Website shall be accurate and current at all times and you shall be obliged to update any change in your contact information on the Website immediately. The Company takes no responsibility for any delay/non-delivery of the goods on account of failure of the Buyer to update the contact information provided on the Website and any consequent negative feedback by the Buyer will be deleted or modified.


• Feedback: You shall use the feedback and review mechanism to communicate your fair opinion and facts in respect of the Seller or the Website or your experience whilst using the Website, known to you from first-hand experience only. You shall not include any hearsay information, or information that results in maligning the Website, Artist, brand or artwork on any social media platforms.


• Limit on Volume of Transactions: The Company reserves the right to limit the amount payable and the volume of the Transaction that may be conducted on a single Valid Card/Valid Bank Account (which shall also include any payment wallet or Unified Payment Interface “UPI”) by a Buyer and may refuse to process Transactions exceeding such limits and may also block certain Valid Cards or Valid Bank Accounts that are suspected to be misused while paying the Transaction Price.


• Verification of Payment: To prevent any misuse, a payment (in whichever method) of the Transaction Price initiated by the Buyer may be flagged or kept on hold for additional checks and verification by the payment processing bank or respective agency, in which case the Company may contact the Buyer for verification of or additional information, details, data and documents. The Company may not confirm the payment if such information, details, data and documents are false, misleading, incorrect or incomplete and consequently the Valid Card and/or the Valid Bank Account will not be charged. In such case, the Dispatch timelines will not commence until Payment Confirmation. The result of the checks and verification shall be communicated to both the Buyer and Seller.


• The Company reserves the right to refuse to process Transaction Price in respect of Transactions by Buyers with a prior history of questionable charges including without limitation breach of any agreements by Buyer with the Company or breach/violation of any applicable law or any charges imposed by the Issuing Bank.


• Delivery: The time (days) within which the Artist is required to ensure Delivery of the items to the Buyer is mentioned on the artwork page. In the case of an order for artworks that have different days of delivery, the higher number of delivery days will be considered.

• Delivery Confirmation: The Buyer shall notify the Website in case of non-Delivery within the stipulated Delivery time.

​

• Refund: A refund claim may either be accepted or rejected by the Company as per the Buyers return Policy. If the refund claim is accepted, then the Transaction Price will be refunded to the Buyer. All payments for refund of the Transaction Price shall be as follows and in accordance with the provisions contained herein and applicable laws in India.
1. Refund, if any, shall be made at the same Issuing Bank from where Transaction Price was received. In the event of any refund, the same shall be issued by way of an electronic transfer or a demand draft in favour of the Buyer.
2. Refunds shall only be made in Indian Rupees and shall be equivalent to the Transaction Price received. Buyer shall bear any foreign exchange conversion risk, loss, charges or fees, if any.
3. For electronics payments, refund shall be made using NEFT/RTGS or any other online banking/electronic funds transfer system approved by Reserve Bank India
4. Refund shall be subject to the Buyer complying with the provisions of the User Agreement and the rules and polices made hereunder and the Company shall have recourse to such refund in case of any misuse by buyer.


• Arrangement with the issuing bank: All Transactions conducted on the Website for which Valid Cards and Valid Bank Accounts are used for remittance of payment will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company and the Buyer shall not violate any such terms and conditions. The Buyer further agrees to indemnify and hold harmless the Company and its service providers against any direct or indirect liability that may arise on account of such violation. All online bank transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank, which shall also include any payment wallet or UPI.

• Taxes and levies: Delivery of items to Buyers located in places where local taxes and levies may be charged will be liable to pay the same to the courier company even though the listing mentioned no taxes or levy.

​

Return and Replacement Guideline
Paintings - All efforts  are made by IAE to ensure that the images and video graphed artwork closely resembles the image. Therefore, we do not take returns for image variations. However, if the artwork reaches the buyer in the damaged form, we expect the buyer to notify the courier company at the time of delivery (this is very important for us to process the refund) and also ensure that the opening of the parcel is video graphed as mentioned on the website, immediately get in touch with us and send pictures / videos of the damaged artwork. We would investigate the issue, and if the Painting is determined to have been damaged in transit, you would get a full refund of the artwork cost paid by you.

​

(Note: IAE shall consider each incidence on case to case basis. It is our policy that in the event of a disagreement, IAE holds the right to make the final call on all returns. We would not be able to process any returns if it is not reported within the stipulated time period.)

​

Returns may be accepted only in following cases:
Transit Damage
• In case of Painting, Buyer shall get refund for the artwork cost paid by you if the artwork is determined to have been damaged in transit, subject to the actual verification.
• The Buyer must make best efforts as mentioned in the website and also to notify the courier company about the damage at the time of delivery. The Buyer should also mention in the Proof of Delivery (POD) document that the shipment is damaged.
• The images/videos of damaged artwork should be sent to IAE by the Buyer at canvas@indianartexchange.com . The case for replacement shall proceed only upon the Buyer sending IAE images/videos of the damaged artwork within stipulated time.
• The Buyer is obliged to return the artwork at his/her own cost to the designated address after packing the item as per its original packaging along with accessories, if any, to ensure no further damage is caused to the artwork.
Note: IAE can however consider not retrieving the artwork depending upon the extent of damage and the cost involved in the retrieval process. IAE shall not be bound in any way to dispose the artwork in case it decides not to retrieve the artwork from the buyer's place owing to unviability of retrieval process. In which case IAE shall inform the Buyer.

 

Non-Delivery
• The Buyer is entitled to full refund if IAE fails to deliver the artwork to the Buyer for reasons other than Buyer's unavailability to receive the artwork or Buyers non-cooperation resulting in Non-Delivery.
• The refund shall take a maximum of fifteen (15) days.
• If the Non-Delivery of artwork happens due to unavailability of the Buyer at the mentioned address, or non-cooperation from Buyer, the delivery shall be re-attempted. If the artwork is still not delivered, the artwork shall be returned by the logistics partner to IAE’s designated address, and intimation of non-delivery will be given to the Buyer In no case shall there be a refund for Non-Delivery due to Buyer's unavailability at the mentioned address or non-cooperation.
• In the above case, the Buyer would have to bear additional shipping cost for having the artwork re-delivered at his/her address.

Artwork not as ordered
• IAE takes adequate measures to verify the current state of the artwork between the buyer and Artist to ensure that the artwork is without any quality defects before it facilitates the shipping of the artwork to the Buyer. However, in case a wrong artwork is delivered inadvertently, IAE shall arrange to deliver the right artwork upon return of the artwork delivered inadvertently. No refunds shall be made in such case. The artwork returned by the Buyer shall be returned in original condition without any damage.
